Purpose:

Part 6 of the Traffic Management Act 2004 allows highway authorities outside of London to use approved camera devices to enforce certain traffic contraventions that were previously only enforceable by the police under criminal law.

 

There are currently 7 bus gates being installed in West Sussex where the use of approved camera devices is being considered. These have been identified as part of local development agreements to allow for public transport access without creating un-desirable new traffic routes through residential developments. 

 

Evidence from two bus gates already installed demonstrates there is considerable non-compliance with the access restriction which needs to be addressed. In addition it will continue to be the case that new bus gates may be agreed as part of planning agreements or in pursuit of specific policy outcomes related to the Bus Service Improvement Plan (BSIP).

Decision:

The Cabinet Member for Highways and Transport has agreed to:

 

  1. approve the requirements for the introduction and use of approved camera devices at bus gates as set out in Appendix 1.
  2. the County Council exercising the powers to enforce traffic contraventions via approved camera devices at the bus gates at Copthorne (Worsell Drive) and Broadbridge Heath (Broadbridge Way).
  3. the County Council exercising powers to enforce traffic contraventions via approved camera devices at bus gates being installed at Horsham (Highwood), Worthing (West Durrington), Crawley (Kilnwood Vale), Angmering (Dappers Lane) and Lancing (New Monks Farm), subject to an initial operational period of six months to monitor the effectiveness of the new access restrictions as detailed in the report.
  4. delegate authority to the Assistant Director (Highways, Transport and Planning) to exercise the powers to enforce traffic contraventions via approved camera devices at any future bus gates, including the allocation of operational responsibility for these functions to the relevant district or borough council in accordance with established arrangements; and
  5. approve the setting of higher rate Penalty Charge Notices (band 2) as detailed in the report.
